My daughter has 2 boys with her ex-boyfriend. They were living in San Jose, Ca. where his family is and she had no family there at all. A couple of years ago they were both on drugs and he left her homeless so she had no way of taking care of the kids. He took the kids and lived with his father and she had no choice but to move back to Arizona with her family. Since moving back to Arizona she got off the drugs, went to school and graduated from Pima Medical College and has been working. In those 2 years without the kids she called them everyday and went and saw them 5-6 times. When they were with their father the oldest who was in Kindergarten had behaviour problems and was kicked out of school. She got a call in April of this year to come and get them because he got arrested for selling and possession. She got a notarized letter from him allowing her to take the kids out of state an enroll them in school. He gave her everything, birth certif., shot records and all of their possessions. It’s been almost 6 months and now he is filing for child custody saying she was suppose to bring them back to him after the summer. She has a court date next week. He has a record and is suppose todo rehab and she has no record at all. The kids are doing wonderful in her care and the oldest is doing great in school, she just had a parent teacher conference and the teacher told her she is doing a great job considering what he has been through. The littlest only ate bread and chips when she got him but now eats everything and they are in a structured household. What are the chances of him getting them back. His family is going to court to tell the judge that the kids are better off with the mother than the father. I don’t know how to handle this since he filed in Ca. and the kids are here with her in Arizona.

I’m not sure about all the legalities, but sounds like the judge will make the right choice. They usually aren’t stupid and they can see through “but I’ll change!” nonsense. Your daughter will win, no doubt.
